Dandee Incorporated Terms of Use

1. Acceptance of Terms
These Terms of Use (“Terms”) govern access to and use of the Dandee mobile application, website, and related services (collectively, the “Service”) provided by Dandee Incorporated (“Dandee,” “we,” “our,” or “us”). By using the Service, you agree to be legally bound by these Terms. If you do not agree, you may not use the Service.
2. Nature of the Service
Dandee operates as a technology platform that assists homeowners with home maintenance tracking, home data organization, analytics, and contractor discovery. Dandee does not provide contracting, construction, repair, inspection, engineering, or trade services and is not a general contractor, subcontractor, construction manager, or employer of any contractor using the platform.
By submitting service requests or using contractor-matching functionality, users authorize Dandee to share relevant property information, maintenance records, project details, and related Home Data with matched contractors for purposes of facilitating quotes, communication, scheduling, maintenance recommendations, and requested services.
All services performed in connection with the Service are provided exclusively by independent third-party contractors. Dandee is not a party to any agreement between users and does not supervise, direct, control, or guarantee any work performed by contractors.
3. Eligibility
Users must be at least eighteen (18) years old to use the Service. Users represent that all information provided is accurate and that they have legal capacity to enter into binding agreements. Contractors further represent that they maintain all necessary licenses, insurance, permits, and certifications required for their services.
4. Account Responsibility
Users are responsible for maintaining confidentiality of their account credentials and for all activity occurring under their account. Dandee may suspend or terminate access at any time for violations of these Terms or conduct deemed harmful to the Service.
5. Subscription Terms
HomeCare Plus auto-renews on a monthly basis at $9.99 USD via Apple In-App Purchase (or Google Play), plus applicable taxes, unless canceled prior to renewal. Pricing may vary by region in accordance with applicable App Store or Google Play requirements and may be adjusted from time to time subject to platform rules and applicable law.
Contractor subscription plans, including access to contractor tools, CRM functionality, scheduling, job management, and related services, are billed at $29.99 USD per month, plus applicable taxes, unless otherwise stated at the time of purchase. Contractor subscription pricing may also vary by region or promotional offering and may be modified in accordance with applicable platform rules and legal requirements.
Subscription payments are processed through third-party platforms such as Apple App Store or Google Play. Dandee does not control billing, refunds, cancellations, or chargebacks for subscriptions purchased through these platforms. Subscription access continues until the end of the applicable billing period following cancellation.
The free tier of the Service is limited to one (1) service request per calendar month. This limitation is enforced programmatically within the Service and may be modified or updated at Dandee’s discretion.
Subscriptions begin immediately upon successful purchase. Cancellation prevents future renewals but does not entitle users to pro-rated refunds unless required by applicable law or platform policy.
6. Home Health Scores and Analytics
The Dandee Home Health Score is a proprietary informational metric generated using user-provided data, maintenance history, and internal analytical methodologies. The Score is provided for informational purposes only and does not constitute a professional inspection, engineering assessment, insurance determination, appraisal, or guarantee of any kind.
Dandee does not warrant or guarantee the accuracy, reliability, or predictive value of any score, recommendation, or maintenance insight. Methodologies may be updated or modified at any time.
7. Contractor Relationships and Disclaimer of Liability
Dandee may, but is not obligated to, conduct limited verification of contractors, which may include license checks, insurance verification, and identity confirmation where reasonably available. Such verification is not exhaustive and does not constitute a guarantee, endorsement, certification, or warranty of any kind.
Users acknowledge and agree that Dandee does not supervise contractor work, does not control job execution, and is not responsible for contractor conduct, workmanship, safety, legality, or outcomes.
To the maximum extent permitted by law, Dandee expressly disclaims all liability arising from interactions between users and contractors, including but not limited to property damage, personal injury, theft, fraud, negligence, or failure to perform services.
8. User Data Responsibility
Users are solely responsible for all information submitted to the Service, including property data, maintenance records, system details, uploaded documents, and any other content. Dandee is not responsible for inaccuracies, omissions, or outdated information provided by users.
9. Messaging and Content
Users may communicate through the Service via messages, photos, videos, and other content. Users agree not to upload unlawful, harmful, or infringing content. Dandee may remove content that violates these Terms but is not obligated to monitor user activity.
10. Payments and Third Parties
Payments are processed by third-party providers. Dandee is not responsible for errors, failures, disputes, or security issues arising from third-party payment processors or integrations.
11. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DANDEE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Dandee does not guarantee contractor performance, home outcomes, platform availability, accuracy of data, or reliability of recommendations or analytics. Use of the Service is at the user’s sole risk.
12. Limitation of Liability
To the fullest extent permitted by law, Dandee shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from use of the Service.
Dandee’s total liability shall not exceed the greater of fifty dollars ($50.00) or the amount paid by the user to Dandee in the twelve (12) months preceding the claim.
13. Indemnification
Users agree to indemnify and hold harmless Dandee Incorporated from any claims, liabilities, damages, or expenses arising from use of the Service, violation of these Terms, interactions with contractors, or submission of user content.
14. Intellectual Property
All intellectual property in the Service, including software, branding, analytics, Home Health Scores, and platform design, belongs to Dandee or its licensors. Users may not copy, reverse engineer, or commercially exploit the Service without written permission.
15. Termination
Dandee may suspend or terminate access at any time. Users may delete their accounts at any time. Certain obligations, including liability waivers and indemnification, survive termination.
16. Governing Law
These Terms are governed by the laws of the State of Connecticut.
17. Dispute Resolution
Any dispute shall first be addressed through informal negotiation. If unresolved, disputes shall be resolved by binding arbitration in Connecticut under the rules of the American Arbitration Association. Users waive the right to jury trial and class actions.
18. Changes to Terms
Dandee may update these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.
